Terms of Service

What Breather is

Breather is a preventative workplace wellbeing service, comprising a desktop application (the Breather app) and scheduled Team Breathers sessions delivered by certified guides. By creating an account, installing the app, or entering into a service agreement with us, you agree to these terms.

Your account

You need an account to use the Breather app. You can sign in with Google or a magic link sent to your email. You're responsible for keeping your account secure and for any activity that happens under it.

You must be at least 16 years old to create an account.

Subscriptions and billing

Team Breathers are sold as annual credit packs to purchasing organisations. The desktop app is an optional add-on billed per seat per month, with seats allocated from a company pool. All payments are processed by Stripe. By subscribing or entering into a service agreement, you authorise the charges described in your quote or written agreement.

  • Annual subscriptions do not auto-renew without confirmation.
  • Desktop app usage is billed monthly based on active users, who are people that complete at least one session in the month.
  • We don't offer partial refunds for unused time within a billing period. If you believe you've been charged in error, contact us at hello@breather.work.
  • Prices may change with reasonable notice. Any price change will apply from your next billing period, not retroactively.

What you get

An active subscription gives you access to:

  • Team Breathers led by a certified Breather guide, at the cadence agreed in your plan
  • The desktop app (if included), with guided and unguided sessions in multiple voices and durations
  • Smart calendar integration and context-aware notification timing
  • All current and future features released during your subscription

Calendar integration

The Breather app can optionally connect to Google Calendar (via read-only OAuth access), Microsoft Outlook, or Apple Calendar (via the native macOS EventKit framework). This is used solely to time pause suggestions around your meetings. You can connect or disconnect your calendar at any time. See our privacy policy for details on how calendar data is handled.

Microphone detection

The Breather app can detect whether your microphone is in use to avoid interrupting you during calls. No audio is recorded, captured, or transmitted. The app only checks whether the microphone is active or inactive. See our privacy policy for more detail.

Analytics and usage data

By using Breather, you consent to the collection of anonymous usage analytics and automated error reports as described in our privacy policy. This includes app usage events (such as feature usage and session metadata), crash and error reports (sent automatically to help us fix bugs), and, on the website, page views and clicks. You can opt out of app analytics at any time via the "Share usage data" toggle in Settings.

Acceptable use

Please use Breather as intended. You agree not to:

  • Share your account with others or circumvent subscription requirements
  • Reverse engineer, decompile, or extract the source code of the app
  • Redistribute, resell, or sublicense Breather or its content
  • Use the service in any way that could harm it or other users

Intellectual property

Breather, including its session content, recordings, interface design, and branding, is owned by Breather. Your subscription grants you a personal, non-transferable licence to use the service. It does not transfer any ownership rights.

Availability

We aim to keep Breather running smoothly, but we can't guarantee uninterrupted access. The service depends on third-party providers (Google Calendar, Microsoft, Apple, Stripe, Supabase, and video conferencing platforms) that may occasionally experience downtime. We're not liable for interruptions caused by factors outside our control.

Limitation of liability

Breather is a wellbeing tool, not a medical service. It is not a substitute for professional mental health care. We provide the service "as is" and make no guarantees about specific outcomes from using it.

To the fullest extent permitted by law, Breather's total liability to you for any claims arising from your use of the service is limited to the amount you've paid us in the 12 months preceding the claim.

Termination

You can stop using Breather at any time by cancelling your subscription and signing out. We may suspend or terminate your account if you violate these terms, with notice where practical.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll notify you through the app or by email. Continued use of Breather after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
